Entry into the New Zealand Mint Design and WIN Your Own Chibi® Coin (“Competition”) is deemed acceptance of these Terms and Conditions. Instructions on ‘How to Enter’ and prize information also form part of these Terms and Conditions.

For the purpose of these Terms and Conditions, the promoter is New Zealand Mint Limited, 48 Greys Avenue, Auckland, New Zealand (“Promoter”).

The Competition is open anyone who meets the conditions of entry (“Entrant”). If contestants are under the age of 18 on the closing date, parent/guardian consent is required to enter this competition.

Entry is not open to directors, management, officers, employees and contractors of the Promoter, their associated agencies and companies, and their immediate families.

The Competition commences at 9am NZST on Monday 22 February 2021. Entries close at 9am NZST on Monday 19 April 2021 (“Competition Period”). Entries received outside of the Competition Period will not be accepted by the Promoter and will be deemed to be invalid. The time of entry will be deemed to be the time the entry is received by the Promoter and not the time of transmission by the Entrant.

This Competition is a game of skill, chance plays no part in determining the winner.

To enter the Competition, the Entrant must submit a design for a Christmas-themed Chibi® Coin to the Promoter by email to competitions@newzealandmint.com. The Entrant should adhere to the Design Template available from http://bit.ly/chibicoin-design-template. The Entrant must provide the design as an attachment to the email and, in the body of the email, provide an outline in English in 50 words or less of the inspiration behind the design (“Entry”).

The attachment must be no more than 5MB and be in one of the following formats: jpg or pdf. Entries must be submitted in accordance with these entry instructions and will not be accepted in any other form.

The Entrant may enter as many times as they like throughout the Competition Period provided that each entry is unique and original.

An Entrant’s Entry must not be late, incomplete or incomprehensible or contain any content that infringes the rights (including intellectual property rights) of any person or is unlawful, obscene, offensive, indecent, defamatory, discriminatory, libellous, threatening, pornographic, harassing, hateful, racially or ethically offensive or otherwise objectionable or inappropriate (which includes, without limitation, any content involving excessive violence, malice or swearing), capable of encouraging conduct that would be considered a criminal offence, capable of violating any law or giving rise to any civil liability.

Once submitted, no changes to or withdrawal of an Entry will be permitted.

The Prize will be awarded by the Promoter following a judging of all valid Entries received within the Competition Period by a panel of judges appointed by the Promoter and located at the Promoter’s head office at 48 Grey’s Avenue, Auckland, New Zealand by 9am Tuesday 20 April 2021. The Entrant who submits the Entry which is judged to be the best Christmas-themed Chibi® Coin will be the competition winner (“Prize Winner”). The Promoter reserves the right to use any subjective criteria it chooses in selecting a winner.

The Promoter’s decision in relation to any or all aspects of this Competition is at its complete discretion, final and binding on all persons who enter into this Competition and no correspondence will be entered into.

The Prize Winner will win the Prize, being:

10 x New Zealand Mint Christmas Chibi® Coins in their packaging with certificate numbers 1 to 10. The Prize is non-exchangeable, non-transferable and is not redeemable for other coins.

The Promoter will put the Prize Winner’s Entry (or a modified version thereof to make it suitable for production, as determined solely by the Promoter) into commercial production (in such volumes and using such production materials and methods as determined by the Promoter in its sole discretion); the coin resulting from such commercial production will be named New Zealand Mint Christmas Chibi® Coin. The Entrant agrees to take any steps necessary to assign all of the Entrant’s rights, title and interest in the intellectual property of the winning Entry to the Promoter.  The Entrant accepts that it will not be entitled to proceeds from the commercial sale of the coin under any circumstances.

By 9am NZST Wednesday 21 April, 2021, the Prize Winner will be notified of their success in winning the Prize by the Promoter by email.

The Winner is required to keep all details relating to their win confidential until the Prize Winner’s Entry is announced as being the winning design to the general public on Friday 30 April 2021.

The Promoter will take no responsibility if any Winner’s contact details are incorrect or incomplete or a Winner cannot be contacted.

The Promoter reserves the right to appoint a new Winner if an original Winner cannot be contacted within 48 hours or if they cannot redeem their Prize. This new Winner will be appointed by conducting a second judging of the valid Entries, such judging to take place in the same manner and at the same premises as the initial judging on a time and date to be determined by the Promoter.

All prizes must be taken as stated and no compensation will be paid if a Winner is unable to use their Prize. In the event that a Prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter will substitute a prize of equal or greater value.

The Winner may be subject to import duties, taxes and customs clearances levied by their country or other overseas authorities once the Prize reaches their country. These charges are not included in the Prize and are the responsibility of the Winner as incurred.

The Promoter will collect Entrants’ personal information for the for the purposes of administering this Competition and to fulfil the Prize and, except your full name, will not publish such information or provide such information to anyone without your permission. If the information requested is not provided, the Entrant may not participate in the Competition. The collection, use and disclosure of personal information provided in connection with this Competition is governed by the Promoter’s privacy policy, available at https://www.nzmint.com/pages/privacy-policy. Information will be held until such time as it is no longer administratively required for the competition.

Entrants consent to the Promoter using the Entrant’s name and entry in the event that they are a Winner in any media for an unlimited period of time without remuneration for the purpose of promoting this Competition (including any outcome) and promoting any goods or services provided by the Promoter.

All Entries may be uploaded onto the Promoter’s website. Entries may also be displayed on the Promoter’s blog, Facebook page, Instagram account, Twitter account, You Tube account or any other social media platform and in any digital communications. The Prize Winner may also be interviewed to be featured in the Promoter’s blog or on other of the Promoter’s digital channels. The Winner must participate in the Prize personally.

By entering this Competition each Entrant warrants to the Promoter that their submitted Entry is an original work of the Entrant, has not been previously published or won any award and does not contain any material which would infringe the rights of any third party, including any copyright, trademark, registered design, patent or any other third-party intellectual property rights. The Entrant agrees to indemnify the Promoter and keep the Promoter indemnified against all claims and costs incurred by third parties arising from a breach of the warranties set out in this clause.

Each Entrant assigns all proprietary rights (including any intellectual property rights) they have in their Entry to the Promoter. Each Entrant acknowledges and agrees that the opportunity to win the prize is valuable consideration and full and final compensation for all rights in and ownership of the selected design. Their Entry becomes the property of the Promoter and the Promoter has the right to alter the design or content of each Entry and use the Entry across any communication or marketing platform owned or used by the Promoter who will own your design and will have the exclusive right to use your design on a worldwide and exclusive basis in perpetuity, including the right to use the design for promotional purposes and any other use or purpose. The Promoter is entitled to use any of the submitted Entries for any purpose, including (but not limited to) any future promotion, marketing or publicity purposes. You agree to waive all moral rights to be acknowledged as the author in New Zealand Mint’s use of the design, other than publicising the awarding of the prize to your design.

The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants (including an Entrant's identity and age) and to disqualify any Entrant who submits an Entry that is not in accordance with these Terms and Conditions or who interferes or tampers with the Entry process or if the Entrant is engaged in any unlawful or other misconduct calculated to jeopardize the fair and proper conduct of the Competition. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

Despite anything to the contrary in these Terms and Conditions, errors and omissions may be accepted at the Promoter's complete discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

The Promoter’s decision in relation to any or all aspects of this Competition is at its complete discretion, final and binding on all persons who enter into this Competition and no correspondence will be entered into.

Any costs associated with entering this Competition are the responsibility of each Entrant.

The Promoter accepts no responsibility for late, lost or misdirected Entries or other communications. Entries will be deemed void if forged, manipulated or tampered with in any way. Incomplete, indecipherable, or illegible Entries will also be deemed invalid and will not be included in the Competition. All Entries are deemed to be received at the time of receipt by the Promoter and not the time of transmission by the Entrant. The Promoter cannot accept responsibility for any Entry not received. The Promoter assumes no responsibility for any failure to receive an Entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches.

Except for any liability which cannot be excluded by law, the Promoter and its associated companies are not responsible for and exclude all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising from or in any way connected with this Promotion, including:

Any problems or technical malfunction (whether or not under the Promoter’s control) of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on any computer system or at any website, or any combination thereof, including (but not limited to) any injury or damage to Entrants or any other person’s property related to or resulting from participation in this Competition;

Any incorrect or inaccurate information, either caused by users or by any of the equipment or programming associated with or utilised in connection with this Competition, or by any technical error that may occur in the course of this Competition;

any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or third part interference or unauthorised access to or alteration of entries or entrants details;

any Entry that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter);

any tax liability incurred by a Winner or entrant (independent financial advice should be sought);

participation in this Competition; or

cancellation of this Competition.

This Competition, or any part or aspect of it, may be changed, varied or withdrawn at any time without prior notification. In the event of any dispute, the Promoter will be the sole arbitrator and its decision will be final (subject to any laws that may apply).

These Terms and Conditions are governed by, and are to be construed in accordance with, the laws enforceable in New Zealand. Each party submits to the exclusive jurisdiction of the courts exercising jurisdiction in New Zealand and any court hearing appeals from those courts.

These Terms and Conditions embody the entire agreement between the Promoter and each Entrant with respect to this Competition.

Any provision in these terms and conditions which is invalid or unenforceable in any jurisdiction is to be read down for the purpose of that jurisdiction, if possible, so as to be valid and enforceable, and otherwise must be severed to the extent of the invalidity or unenforceability, without affecting the remaining provisions of these Terms and Conditions or affecting the validity or enforceability of that provision in any other jurisdiction.
